Law with no enforcer: HHS turns its back on drug diversion

Abstract:

The problems surrounding the lack of effort by the Food and Drug Administration to enforce the Prescription Drug Marketing Act are described. The responsibility for enforcement which has been passed around from the Department of Health and Human Services, Federal Bureau of Investigation and the Department of Justice, the reluctance of the FDA to enforce the law because the agency perceives it will only exacerbate its current problems with the pharmaceutical industry and the actions of various pharmaceutical organizations, including the National Association of Retail Druggists to push the FDA to enforce the law and stop drug diversion and discriminatory pricing are discussed.
