Abstract:

The Pharmaceutical Manufacturers Association of Canada’s report recommending the repeal of the compulsory licensing provisions (Section 41) of the Patent Act, and the creation of a regulatory approval process that is competitive with those countries where the early investigative drug research is conducted, is discussed. The effects of granting compulsory licenses to generic manufacturers and the shortage of qualified prescription drug review personnel on research and innovation in the Canadian pharmaceutical industry are described.
