FTC's rules: get set for long controversy

Abstract:
The FTC’s (Federal Trade Commission) proposal for the disclosure of retail prices for prescription drugs for the purpose of free market competition is discussed. The text of the FTC’s proposed rules plus the APhA, NACDS (National Association Chain Drug Stores) and NARD (National Association of Retail Druggists) responses to the proposed action are presented. A state in which the pharmacy law and/or board regulation has forbidden advertising and the state pharmaceutical association code of ethics has deemed advertising as unethical (34 states in all) is the reason cited for possible conflict for the pharmacist to the disclosure of drug prices. The authority of a federal agency to override state laws and regulations is questioned.
