Pharmaceutical advertising

Abstract:

Pharmaceutical manufacturers are not required to submit advertising copy to the Food and Drug Directorate for review prior to publicaton. Consequently, the onus is on the Food and Drug Directorate to demonstrate in a court of law that an advertisement is, in fact, false or misleading. Under the constraints of the legislation, the Committee readily appreciates the difficulties in obtaining a conviction. A review of a series of ads for oral contraceptives found that often there is little emphasis on the provision of complete and factual information.
